Lawpath has 2 different options to help with the set-up of your new Trust



1. Lawyer-Assisted Discretionary Trust Set Up

End-to-end trust establishment by a Lawpath Lawyer for the fixed fee.


We will assist you with the requisite steps including:

  • Lawyer advice explaining how a trust operates and the roles of the settlor, appointor, trustee and beneficiaries.

  • [Optional] Incorporation of a corporate trustee, if you want a company to act as the trustee for the trust (for an additional fee)

  • The drafting of a trust deed, including one round of consultations and key term amendments.

  • We will act as settlor to establish the trust, and third party witness to witness signatures, where needed.

  • Electronic signing of the trust deed, including the settlor and witness.

  • Payment of stamp duty where required.

  • A letter from the Settlor certifying the electronic trust deed is the original, to establish a bank account for the trust.

  • [Optional] Setting up an Australian Business Number and Tax File Number for the trust and/or corporate trustee - (for an additional fee)

2. Lawpath DIY Trust Set Up Workflow

A step-by-step workflow to set up a trust on your own. This DIY option is for those confident about the Trust process and do not need legal support to create the Deed.
