Ready to start your company application? Here is a list of information you will need to provide:
Company Name
Choose a company name to use. Lawpath's name checker will determine if the name is available to be used and there are certain rules governing your choice of name.

If you already own an existing business name you will need to provide the ABN it is currently registered to transfer the name across.
Company Registration State
Your company will be registered Australia-wide, but it is necessary to nominate a state to be registered in. State registration is important to consider if your company will apply for any grants, securing property and tax purposes. If you require to change your state later on, there will be ASIC fees involved.
Registered Office Address and Principal Place of Business
Companies are required to disclose their registered office and business addresses. These can be the same address, and both will be public information that can be requested on an ASIC company extract. The address must be in Australia (not a PO Box) and all communication and correspondence with the company will be directed to the Registered Office Address. Company Officeholders
Officeholders refer to your directors and secretaries. This can be a single person, or multiple people in the roles.
Companies are required to have at least one director, but appointing one (or more) secretaries is optional. You will need to provide the full name (including middle name or as set out on identity documents), full residential address as well as the date and place of birth for each officeholder listed.
Directors will need to have a Director ID number. This can be applied for directly with the ABRS website, and only needs to be done once per director. The Director ID should be registered before the documents are signed.
Shareholders
These are the owners of shares in the company who are legally obliged to pay the agreed amount of each share. You will need to provide their full name (including middle name or as set out on identity documents), address and number of shares for each shareholder of the company.
Share Structure
This includes the total number of shares (note: a company must issue at least one share to one shareholder), the share class or classes available, and the dollar amount of these shares that are paid and unpaid.
If you are also applying for a new ABN for the company, you will need to provide the personal TFN for the directors and shareholders to ensure a quick turn around on the application. Not providing the TFN can cause delays of 28 days
