What is a Residential Director?

Under the Corporations Act 2001 (Cth), proprietary companies (those with names ending in Proprietary Limited or Pty Ltd) require a minimum of one director, including one who ordinarily resides in Australia. This means all companies incorporated in the country must appoint at least one director who is a resident of Australia. This person can either be an Australian citizen or a migrant who has the right to work and live in the country.

Many international companies do not have a local director and therefore are required to use what is called a ‘Nominee Local Director’. This is a lawyer or accountant who acts as a director for your company in Australia in order to meet all legal obligations.
